Is Insurance Mandatory for Electric Scooters in Spain?
If you live in Spain and use an electric scooter to get around, it is important to be aware of the latest legal requirements that apply to these vehicles.
Yes. In Spain, third-party liability insurance is mandatory for electric scooters that are classified as Personal Mobility Vehicles (PMVs).
Which electric scooters are covered?
In general, Personal Mobility Vehicles include single-person vehicles powered exclusively by an electric motor, with a maximum design speed of between 6 and 25 km/h, provided they meet the applicable technical requirements.
Therefore, if you use a standard electric scooter with a maximum speed of 25 km/h, it is very likely to fall within this category.
What does the insurance cover?
The mandatory insurance is designed to cover third-party liability.
This means that if you cause injury to another person or damage to their property while using your electric scooter, your insurance may cover the resulting compensation, subject to the terms, conditions and limits of the policy.
For example, insurance may be particularly important if you:
- Cause an accident involving a pedestrian.
- Damage another vehicle.
- Cause damage to property.
- Injure another person as a result of an accident.
Having insurance not only helps you comply with Spanish regulations, but also provides valuable financial protection in the event of an accident.
Is any insurance policy sufficient?
Not necessarily. It is important to make sure that your policy meets the legal requirements for Personal Mobility Vehicles and provides the level of cover you need.
The new regulations also introduce requirements relating to the identification and registration of these vehicles, so it is advisable to check that your electric scooter and its documentation comply with the applicable requirements.
Electric scooters that were already in use before certain requirements came into force may benefit from transitional arrangements. The specific situation can therefore depend on when your scooter was placed into circulation.
What if I am a foreign resident in Spain?
If you are an expatriate living in Spain, the rules governing the use of electric scooters generally apply to you in the same way as they do to other users.
If you use an electric scooter to get around Málaga or another Spanish city, it is therefore advisable to check that:
✓ Your electric scooter meets the applicable legal requirements.
✓ It is correctly identified or registered when required.
✓ You have the mandatory third-party liability insurance.
✓ You are familiar with the traffic and mobility regulations applicable in your municipality.
Local authorities may also establish additional rules concerning where and how Personal Mobility Vehicles can be used.
