Tomás Pérez Benz (hereinafter, “Expatcenter.info”) informs Users of this website about its policy regarding the processing and protection of personal data that may be collected through the website when browsing, submitting contact, enquiry or subscription forms, contracting services or purchasing products.

Who is the Data Controller responsible for processing your personal data?

Expatcenter.info is the Data Controller responsible for processing the User’s personal data and informs the User that such data will be processed in accordance with the applicable European and Spanish regulations on the protection of personal data, including Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation – GDPR), concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

Why do we process your personal data?

To maintain a professional relationship with the User. The processing activities envisaged are:

• Sending commercial and promotional communications by email, fax, SMS, MMS, social media or any other electronic or physical means, whether existing now or developed in the future, that enable commercial communications. These communications will be sent by the Data Controller and will relate to its products and services, or to those of its partners or suppliers with whom it has entered into a promotional agreement. In such cases, third parties will never have access to the personal data.
• Conducting market research or statistical analysis.
• Processing orders, requests or any other type of enquiry submitted by the User through any of the contact methods made available on this website.

On what legal grounds may we process your personal data?

Your personal data may be processed on the legal grounds set out in Article 6 of the GDPR, as described below:

How long will we keep your personal data?

Personal data will be retained for no longer than is necessary to fulfil the purpose for which it is processed, or for as long as there are legal obligations requiring its retention. Where processing is based on the User’s consent, the data will be retained until such consent is withdrawn.

Once the data are no longer necessary for the purposes described above, they will be deleted using appropriate security measures designed to ensure the anonymisation or complete destruction of the data.

Who do we disclose your personal data to?

No disclosure of personal data to third parties is envisaged, except where required by law or where necessary for the development and fulfilment of the purposes of the processing. In the latter case, data may be disclosed to our service providers relating to communications, marketing or logistics, with whom the Data Controller has entered into the confidentiality and data-processing agreements required under the applicable privacy regulations.

No international transfer of personal data is envisaged.

What are your rights?

• The right to withdraw your consent at any time.
• The right of access, rectification, portability and erasure of your personal data, as well as the right to restrict or object to its processing.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing of your personal data does not comply with the applicable regulations.

2. Mandatory or Optional Nature of the Information Provided by the User

By ticking the relevant boxes and entering data in fields marked with an asterisk (*) in contact, registration, subscription and other forms, or in download forms, the User expressly, freely and unequivocally accepts that such data are necessary for the Data Controller to process their request. The completion of the remaining fields is voluntary.

All data requested through the website and marked with (*) are mandatory, as they are necessary to provide the User with an optimal service. Although completion of the remaining fields is optional, providing this information may be advisable in order to have all the information necessary to respond appropriately to the User’s enquiry. If all the requested data are not provided, the Provider cannot guarantee that the information and services it provides will be fully tailored to the User’s needs.

The User guarantees that the personal data provided to the Provider are accurate and undertakes to notify the Provider of any changes to such data.

3. Security Measures

In accordance with the applicable regulations on the protection of personal data, the Data Controller complies with all requirements applicable to the processing of personal data under its responsibility and, in particular, with the principles set out in Article 5 of the GDPR and Title II of the LOPDGDD. Accordingly, personal data are processed lawfully, fairly and transparently in relation to the data subject, and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The Provider guarantees that it has implemented appropriate technical and organisational policies and measures in accordance with the GDPR and the LOPDGDD in order to protect the rights and freedoms of Users and has provided them with the appropriate information enabling them to exercise those rights.

SOCIAL MEDIA PRIVACY POLICY

1. Information for Users

Who is the Data Controller responsible for processing your personal data?

Expatcenter.info, hereinafter the DATA CONTROLLER, informs the USER that it has created profiles on the social networks Facebook, Instagram, Twitter and LinkedIn. The DATA CONTROLLER is responsible for processing the User’s personal data carried out through these social networks and informs the User that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). The following information regarding such processing is therefore provided:

Why do we process your personal data?

Purpose of processing:

To maintain a relationship between the USER and the DATA CONTROLLER, which may include the following activities:

• Processing requests and enquiries submitted to the Data Controller.
• Providing information about activities and events organised by the Data Controller.
• Providing information about products or services offered by the Data Controller.
• Interacting through the official profiles.

On what grounds may we process your personal data?

Legal basis for processing: Article 6.1(a) of the GDPR: the data subject has given consent to the processing of their personal data for one or more specific purposes.

The USER has a profile on the relevant social network and has chosen to join the DATA CONTROLLER’s social network, thereby showing an interest in the information published there. Therefore, when requesting to follow our official profiles, the USER provides consent to the processing of the personal data published on their profile.

The USER may access the privacy policies of the relevant social network at any time and configure their profile to ensure their privacy.

The DATA CONTROLLER has access to and processes the USER’s publicly available information, particularly their contact name. This data is used only within the social network itself and will only be incorporated into a file maintained by the DATA CONTROLLER when necessary to process the USER’s request.

How long will we keep your personal data?

Data retention criteria: Personal data will be retained for as long as the USER does not withdraw the consent given, as indicated in this Privacy Policy.

Who do we disclose your personal data to?

Data disclosure: Information provided by the USER through the DATA CONTROLLER’s social media profiles, including personal data, may be published depending on the services used by the USER and may therefore become publicly available to other users of the social networks.

From the profile of each social network, the USER may configure what information they wish to make public in each case, view the permissions that have been granted, remove or disable them, as well as disable any third-party application that they no longer wish to use.

No disclosure of personal data to third parties outside the social network is envisaged, except where strictly necessary for the development and fulfilment of the purposes of the processing, in which case the data may be disclosed to our communications service providers, with whom the DATA CONTROLLER has entered into the confidentiality and data-processing agreements required by the applicable privacy regulations.

What are your rights?

Rights of the USER: These rights may only be exercised in relation to information under the control of the DATA CONTROLLER.

• The right to withdraw consent at any time.
• The right of access, rectification, portability and erasure of personal data, as well as the right to restrict or object to its processing.

2. Use of the Profile

The DATA CONTROLLER will carry out the following activities:

• Accessing publicly available information on the profile.
• Publishing on the USER’s profile any information already published on the DATA CONTROLLER’s social network.
• Sending personal and individual messages through the social network’s communication channels.
• Publishing page status updates that will appear on the USER’s profile.

The USER may at all times control their connections, delete content that is no longer of interest to them and restrict who they share their connections with. To do so, they must access their privacy settings.

3. Publications

Once the USER becomes a follower of or joins the DATA CONTROLLER’s social network, they may publish comments, links, images, photographs or any other type of multimedia content supported by the platform.

In all cases, the USER must be the owner of the published content, hold the relevant copyright and intellectual property rights, or have obtained the consent of any affected third parties.

The publication on the social network of any texts, graphics, photographs, videos or other content that is contrary to or liable to be contrary to morality, ethics, good taste or propriety, and/or that infringes, violates or breaches intellectual or industrial property rights, image rights or the law, is expressly prohibited.

In such cases, the DATA CONTROLLER reserves the right to remove the content immediately, without prior notice, and may request the permanent blocking of the USER.

The DATA CONTROLLER shall not be responsible for content freely published by a USER.

The USER must bear in mind that their publications will be visible to other users and is therefore primarily responsible for their own privacy.

Images that may be published on the social network will not be stored in any file by the DATA CONTROLLER, although they will remain on the social network.

4. Data Relating to Minors or Persons with Disabilities

Access to and registration through the DATA CONTROLLER’s social networks is prohibited to persons under 18 years of age.

If the USER has a disability or requires legal support, the intervention of the holder of parental responsibility or guardianship, or of their legal representative, will be required by means of a valid document proving such representation.

The DATA CONTROLLER shall be expressly exempt from any liability that may arise from the use of the social networks by minors or persons with disabilities.

The DATA CONTROLLER’s social networks do not knowingly collect personal information from minors. Therefore, if the USER is under 18 years of age, they must not register, use the DATA CONTROLLER’s social networks or provide any personal information.

1.- Información al usuario

Tomás Pérez Benz (en lo sucesivo ‘Expatcenter.info’) informa a los Usuarios del presente sitio web sobre su política respecto del tratamiento y protección de los datos de carácter personal que puedan ser recabados a través de su sitio web por la navegación, envío de formularios de contacto, de consulta o suscripción, contratación de servicios o adquisición de productos.

¿Quién es el Responsable del tratamiento de sus datos personales?

Expatcenter.info es el Responsable del tratamiento de los datos personales del Usuario y le informa que estos datos serán tratados de conformidad con lo dispuesto en las normativas europea y española vigentes en materia de protección de datos personales, el Reglamento (UE) 2016/679, de 27 de abril de 2016 (RGPD) relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, y la Ley Orgánica (ES) 3/2018, de 5 de diciembre, de Protección de Datos y Garantía de Derechos Digitales (LOPDGDD).

¿Para qué tratamos sus datos personales?

Para mantener una relación profesional con el usuario. Las operaciones previstas para realizar el tratamiento son:

• Remisión de comunicaciones comerciales publicitarias por email, fax, SMS, MMS, redes sociales o cualquier otro medio electrónico o físico, presente o futuro, que posibilite realizar comunicaciones comerciales. Estas comunicaciones serán realizadas por el Responsable y estarán relacionadas con sus productos y servicios, o con los de sus colaboradores o proveedores con los que éste haya alcanzado algún acuerdo de promoción. En este caso, los terceros nunca tendrán acceso a los datos personales.
• Realizar estudios de mercado o análisis estadísticos.
• Tramitar encargos, solicitudes o cualquier tipo de petición que sea realizada por el usuario a través de cualquiera de las formas de contacto que se ponen a su disposición en el presente sitio web.

¿Por qué motivos podemos tratar sus datos personales?

Porque el tratamiento de los datos está legitimado por el artículo 6 del RGPD según se informa a continuación:

¿Durante cuánto tiempo guardaremos sus datos personales?

Se conservarán durante no más tiempo del necesario para mantener el fin del tratamiento o mientras existan prescripciones legales que dictaminen su custodia y, en los casos en los que el tratamiento dependa del consentimiento del usuario, hasta que éste lo revoque.

Cuando los datos ya no sean necesarios para las finalidades descritas, se suprimirán con medidas de seguridad adecuadas para garantizar la anonimización de los datos o la destrucción total de los mismos.

¿A quién facilitamos sus datos personales?

No está prevista ninguna comunicación de datos personales a terceros salvo por obligación legal o en el caso de que fuese necesario para el desarrollo y ejecución de las finalidades del tratamiento. En este último caso, los datos podrán ser comunicados a nuestros proveedores de servicios relacionados con las comunicaciones, el marketing o la logística, con los cuales el Responsable tiene suscritos los contratos de confidencialidad y de encargado de tratamiento exigidos por las normativas vigentes de privacidad.

No está previsto realizar transferencia de datos internacional.

¿Cuáles son sus derechos?

• Derecho a retirar el consentimiento en cualquier momento.
• Derecho de acceso, rectificación, portabilidad y supresión de sus datos y de limitación u oposición a su tratamiento.
• Derecho a presentar una reclamación ante la Autoridad de control (www.aepd.es) si considera que el tratamiento no se ajusta a la normativa vigente.

2.- Carácter obligatorio o facultativo de la información facilitada por el usuario

Mediante la marcación de las casillas correspondientes y la introducción de los datos en los campos marcados con un asterisco (*) en formularios de contacto, de registro, suscripción, etc., o presentados en formularios de descarga, el Usuario acepta expresamente y de forma libre e inequívoca, que sus datos son necesarios para atender su petición por parte del Responsable, siendo voluntaria la inclusión de datos en los campos restantes. 

Todos los datos solicitados a través del sitio web y marcados con (*) son obligatorios ya que son necesarios para la prestación de un servicio óptimo al Usuario. El resto de campos, aunque introducirlos resulte facultativo, puede ser conveniente su cumplimentación para disponer de toda la información necesaria para contestar adecuadamente a su consulta. En caso de que no sean facilitados todos los datos, no se garantiza que la información y servicios que el Prestador le facilite, sean completamente ajustados a sus necesidades.

El Usuario garantiza que los datos personales facilitados al Prestador son veraces y se hace responsable de comunicar cualquier modificación de los mismos. 

3.- Medidas de seguridad

Que de conformidad con lo dispuesto en las normativas vigentes en materia de protección de datos personales, el Responsable está cumpliendo con todas las disposiciones exigibles para el tratamiento de los datos personales de su responsabilidad, y manifiestamente con los principios descritos en el artículo 5 del RGPD y el Título II de la LOPDGDD, por el cual son tratados de manera lícita, leal y transparente en relación con el interesado y que son adecuados, pertinentes y limitados a lo necesario en relación con los fines para los que son tratados.

El Prestador garantiza que ha implementado políticas técnicas y organizativas apropiadas para aplicar las medidas de seguridad que establecen el RGPD y la LOPDGDD con el fin de proteger los derechos y libertades de los Usuarios y les ha comunicado la información adecuada para que puedan ejercerlos.

POLÍTICA DE PRIVACIDAD EN REDES SOCIALES

1. Información al usuario

¿Quién es el responsable del tratamiento de tus datos personales?

Expatcenter.info, en adelante, RESPONSABLE, informa al USUARIO de que ha procedido a crear un perfil en las Redes Sociales Facebook, Instagram, Twitter, y LinkedIn, que es el responsable del tratamiento de los datos personales del usuario que se lleve a cabo en dichas redes sociales y le informa de que estos datos serán tratados de conformidad con lo dispuesto en el Reglamento (UE) 2016/679, de 27 de abril (GDPR), y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD), por lo que se le facilita la siguiente información del tratamiento:

¿Para qué tratamos tus datos personales?

Fin del tratamiento: mantener una relación entre el USUARIO y el RESPONSABLE que puede incluir las siguientes operaciones:

• Tramitar solicitudes y consultas planteadas al responsable
• Informar sobre actividades y eventos organizados por el responsable
• Informar sobre productos o servicios ofrecidos por el responsable.
• Interactuar a través de los perfiles oficiales.

¿Por qué motivo podemos tratar tus datos personales?

Base jurídica del tratamiento: artículo 6.1.a GDPR, el interesado ha dado su consentimiento para el tratamiento de sus datos personales para uno o varios fines específicos. El USUARIO dispone de un perfil en la misma red social y ha decidido unirse a la red social del RESPONSABLE mostrando así interés en la información que se publique en la misma, por tanto, en el momento de solicitar seguir nuestros perfiles oficiales, nos facilita su consentimiento para el tratamiento de aquellos datos personales publicados en su perfil.

El USUARIO puede acceder en todo momento a las políticas de privacidad de la propia red social, así como configurar su perfil para garantizar su privacidad.

El RESPONSABLE tiene acceso y trata aquella información pública del USUARIO, en especial, su nombre de contacto. Estos datos solo son utilizados dentro de la propia red social y únicamente se incorporarán a un fichero del RESPONSABLE cuando sea necesario para tramitar la petición del USUARIO.

¿Durante cuánto tiempo guardaremos tus datos personales?

Criterios de conservación de los datos: se conservarán mientras el USUARIO no revoque el consentimiento prestado tal y como se indica en esta política de privacidad.

¿A quién facilitamos tus datos personales?

Comunicación de los datos: la información facilitada por el USUARIO a través de las redes sociales del RESPONSABLE, incluidos sus datos personales, puede ser publicada, siempre en función de los servicios que el USUARIO utilice, por lo que podrá quedar a disposición pública de otros terceros usuarios de las redes sociales. Desde el perfil de cada red social, el USUARIO puede configurar qué información quiere hacer pública en cada caso, ver los permisos que se han concedido, eliminarlos o desactivarlos, como cualquier aplicación de un tercero que ya no se desea utilizar.
No está prevista ninguna comunicación de datos personales a terceros fuera de la red social salvo, si fuese imprescindible para el desarrollo y ejecución de las finalidades del tratamiento, a nuestros proveedores de servicios relacionados con comunicaciones, con los cuales el RESPONSABLE tiene suscritos los contratos de confidencialidad y de encargado de tratamiento exigidos por la normativa vigente de privacidad.

¿Cuáles son tus derechos?

Derechos que asisten al USUARIO: solo podrán satisfacerse en relación a aquella información que se encuentre bajo el control del RESPONSABLE.

• Derecho a retirar el consentimiento en cualquier momento.
• Derecho de acceso, rectificación, portabilidad y supresión de sus datos, y de limitación u oposición a su tratamiento.
• Derecho a presentar una reclamación ante la autoridad de control (www.aepd.es) si considera que el tratamiento no se ajusta a la normativa vigente.

2. Utilización del perfil

El RESPONSABLE realizará las siguientes actuaciones:

• Acceso a la información pública del perfil.
• Publicación en el perfil del USUARIO de toda aquella información ya publicada en la red social del RESPONSABLE.
• Enviar mensajes personales e individuales a través de los canales de la red social.
• Actualizaciones del estado de la página que se publicarán en el perfil del USUARIO.

El USUARIO siempre puede controlar sus conexiones, eliminar los contenidos que dejen de interesarle y restringir con quién comparte sus conexiones; para ello deberá acceder a su configuración de privacidad.

3. Publicaciones

El USUARIO, una vez sea seguidor o se haya unido a la red social del RESPONSABLE, podrá publicar en esta comentarios, enlaces, imágenes, fotografías o cualquier otro tipo de contenido multimedia soportado por la misma. El USUARIO, en todos los casos, debe ser el titular del contenido publicado, gozar de los derechos de autor y de propiedad intelectual o contar con el consentimiento de los terceros afectados.

Se prohíbe expresamente cualquier publicación en la red social, ya sean textos, gráficos, fotografías, vídeos, etc. que atenten o sean susceptibles de atentar contra la moral, la ética, el buen gusto o el decoro, y/o que infrinjan, violen o quebranten los derechos de propiedad intelectual o industrial, el derecho a la imagen o la Ley.

En estos casos, el RESPONSABLE se reserva el derecho a retirar de inmediato el contenido, sin comunicación previa, pudiendo solicitar el bloqueo permanente del USUARIO.

El RESPONSABLE no se hará responsable de los contenidos que libremente ha publicado un USUARIO.

El USUARIO debe tener presente que sus publicaciones serán conocidas por otros usuarios, por lo que él mismo es el principal responsable de su privacidad.

Las imágenes que puedan publicarse en la red social no serán almacenadas en ningún fichero por parte del RESPONSABLE, pero sí que permanecerán en la red social.

4. Datos de menor de edad o personas con capacidades especiales

El acceso y registro a través de las redes sociales del RESPONSABLE está prohibido a menores de 18 años. Por su parte, si el USUARIO tiene capacidades especiales, será necesaria la intervención del titular de su patria potestad o tutela, o de su representante legal mediante documento válido que acredite la representación.

El RESPONSABLE quedará expresamente exonerado de cualquier responsabilidad que pudiera derivarse del uso de las redes sociales por parte de menores o personas con capacidades especiales. Las redes sociales del RESPONSABLE no recogen conscientemente ninguna información personal de menores de edad, por ello, si el USUARIO es menor de edad, no debe registrarse, ni utilizar las redes sociales del RESPONSABLE ni tampoco proporcionar ninguna información personal.
